Be it enacted by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:

1 Amendments to the British National (Overseas) Act 2019

  1. A Section 1, paragraph (6) is added to the British National (Overseas) Act 2019 reading as such:
    The children and spouses of current British National (Overseas) passport holders will be made eligible to receive British National (Overseas) passports, with the full rights and privileges of
  2. A Section 11, paragraph (7) is added to the British National (Overseas) Act 2019 reading as such:
    Current and former residents of Hong Kong who have documentation that they resided in Hong Kong on or before July 1, 1997 will be made eligible to apply for and receive British National (Overseas) passports
  3. A Section 1, paragraph (8) is added to the British National (Overseas) Act 2019 reading as such:
    Applicants for British National (Overseas) passports made eligible under paragraphs (6) and (7) shall not be eligible is there is reasonable suspicion by the secretary of state that they have directly engaged in activities as defined by Section 4 of the Hong Kong Treaty Enforcement Obligation Act 2019

2 Short title, commencement and extent

  1. This Act may be cited as the British National (Overseas) Act 2020.
  2. This Act comes into force within three months of the passing of this Act.
  3. This Act extends to the whole of the United Kingdom of Great Britain and Northern Ireland and its Overseas Territories.
