An Act to ease acquisition of British citizenship by British Nationals (Overseas), and to ease restrictions as regards immigration controls and freedoms of movement accorded to British Nationals (Overseas).

Be it enacted by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows

1 British National (Overseas)

  1. All current British Nationals (Overseas) passport holders born before 1 July 1997 be granted the right to trade in their passports in return for standard British passports, such that they may acquire the right of abode and ease of freedom of movement within the United Kingdom, with priority given to British Nationals (Overseas) who have lost the right of abode in Hong Kong.
  2. All current holders of British National (Overseas) passports entering the United Kingdom be granted the ability to use automated passport clearance channels, with British National (Overseas) passports to be upgraded in order to facilitate compatibility with the biometric recognition systems of e-passport gates.
  3. Reduction of the price of renewal for British National (Overseas) passports from the current £114 to £30.
  4. No fee or payment be required for trade-ins of British National (Overseas) passports for British ones at all British consular services.
  5. Abolition of all travel and residence restrictions as outlined in the British Nationality Act 1981 directed against British Nationals (Overseas), permitting British Nationals (Overseas) the ability to remain within the United Kingdom indefinitely.
  6. The children and spouses of current British National (Overseas) passport holders will be made eligible to receive British National (Overseas) passports, with the full rights and privileges of
  7. Current and former residents of Hong Kong who have documentation that they resided in Hong Kong on or before July 1, 1997 will be made eligible to apply for and receive British National (Overseas) passports
  8. Applicants for British National (Overseas) passports made eligible under paragraphs (6) and (7) shall not be eligible is there is reasonable suspicion by the secretary of state that they have directly engaged in activities as defined by Section 4 of the Hong Kong Treaty Enforcement Obligation Act 2019

2 British Overseas Citizens of Hong Kong origin

  1. All current British Overseas Citizens born before 1 July 1997 whose documents were first issued in Hong Kong before that date be granted the right to trade in their passports in return for standard British passports, such that they may acquire the right of abode and ease of freedom of movement within the United Kingdom, with priority given to British Overseas Citizens who have lost the right of abode in Hong Kong.
  2. All current holders of British Overseas Citizen passports entering the United Kingdom be granted the ability to use automated passport clearance channels, with British National (Overseas) passports to be upgraded in order to facilitate compatibility with the biometric recognition systems of e-passport gates.

3 Extent, commencement, and short title

  1. This Act may be cited as the British National (Overseas) Act 2019.
  2. This Act comes into force within three months of the passing of this Act.
  3. This Act extends to the whole of the United Kingdom of Great Britain and Northern Ireland and its Overseas Territories.
